law paternalistic? Provide examples. Explain the distinction between
“pure” and “impure” paternalistic laws according to Dworkin. Next,
explain whether paternalistic laws can be legitimate according to (i)
Mill’s Harm principle, (ii) Natural Law theory’s claim that the function
of law is to promote the common good, and (iii) the Retributivist’s
claim that punishment is justified when it gives the offender what he
deserves (keeping in mind that a paternalistic law will necessarily be
accompanied by a punishment for violation). For each, be sure to discuss
both the case of a pure and impure paternalistic law.
