Explain the
concepts of “under-inclusive”, “over-inclusive”, and “forbidden”
classifications. Are, according to Tussman and tenBroek, laws that
classify in these ways objectionable because they treat people
unequally? Or are they consistent with the ideal of equality? Explain
what Tussman and tenBroek say on this question AND provide your
assessment of whether their answer is accurate. Finally, explain the
grounds on which Brown v. Board of Education found the “separate but
equal” doctrine in public education to be unconstitutional. Does the
decision in Brown treat racial classifications as “forbidden” in the
above sense? Explain your answer.
